The Trump Administration is seeking the approval of a Federal Judge for Liberia

President Donald Trump’s administration is calling a federal judge to approve the deportation of Kilmar Arego Garcia to Liberia on Friday, which he has opposed to all legal challenges.

Friday’s filing is the latest in the administration’s efforts to prosecute Arego Garcia for a second time following his extradition to El Salvador earlier this year. The Department of Justice called on US District Court Judge Paula Xinis to cancel the deportation, saying that Charegi Garcia failed to establish that he would face prosecution in Liberia.

“Petitioner’s claims have been successively barred multiple times and fail to prevail in any event,” the DoJ argued. “This court should annul its original order and allow the government to remove the applicant from Liberia.”

The lawyers said that Liberia had made a “sufficient and credible” argument that Arego Garcia would not be in danger.

Still, Abrego Garcia’s lawyers say he never received sufficient due process to obtain his deportation.

“The government insists that the ineffective determination of the immigration officer – who concluded that Arego Garcia failed to find that ‘it is possible that he will be persecuted or tortured,’ tortured,” written in Libellent.

His lawyer also said Arego Garcia is a victim of retroactive prosecution, noting that Costa Rica has already agreed to accept his deportation flight in refugee status. The US has said it will not send him to Costa Rica unless he pleads guilty to human trafficking.

Earlier in this case, Arego Garcia’s lawyers pointed to more than 20 countries that he is suspected of fearing or prosecuting or being removed from when he was removed from there. Liberia was not among those on the list.

“Liberia is the closest democracy to the United States’ independence on the African continent,” the DoJ argued in October.
